Acceptable Use Policy
Terms & Conditions
Any usage of services provided by Mid-Maine Communications constitutes acceptance of this agreement. It is the responsibility of each subscriber to exercise such control and discretion as is necessary to comply with the conditions of this Acceptable Use Policy and the subscriber agrees to indemnify and hold harmless Mid-Maine Communications for any damages caused by violation thereof.
Mid-Maine Communications reserves the right to refuse service to anyone for any reason. We reserve the right to make modifications to these operating rules without any prior notification. It is the responsibility of our clients to refer to this document as often as is necessary. Users accounts that are terminated or restricted as a result of breach of MMC policy are not subject to any refunds and will be subject and responsible for any termination liability.
Mid-Maine Telecom, Mid-Maine Telplus, and Mid-Maine Long Distance are all subsidiaries of Mid-Maine Communications, and as such are all subject to the terms and conditions set forth and contained herein.
Toll Free Dialup Access Number
Mid-Maine Communications has established a single number for use statewide in Maine for Internet users to connect. The new number is 500-699-6436. If you are still using an older or previously issued number from us, please discontinue use of the old number and begin using the new number immediately.
Please note: You must verify that the number you are dialing is toll free with your local telephone company before using it. Mid-Maine Communications and Verizon telephone customers will always be able to dial the 500-699-6436 number toll free. The PUC has required that all independant telephone companies in Maine also honor 500 numbers as local. There are however some cases where depending on the company you are using, or the plan you subscribe to - that the number may not be treated as local.
Mid-Maine Communications will not be held responsible for any toll incurred resulting from calls made to our Internet access numbers if the user failed to verify that the number is local.
Service Level Agreement
MMC (Mid-Maine Communications) guarantees any dedicated customer (standard dialup, or other shared services excluded) the following when transit is between any MMC core or backbone router or switch where the facilities are 100% MMC owned and operated:
- Network Latency shall never exceed 65 milliseconds round trip
- Packet delivery of 99%
- MMC network (as defined in the applicable service agreement) available 100% of the time.
- Any remedy to SLA conditions not being met, are subject to the terms and conditions defined in the applicable service agreement
Mail Server Use MMC hereby grants its users who are connected to the Internet either by dialup or dedicated connection, limited access to its POP and SMTP mail servers, addressed and accessible by pop.midmaine.com and mail.midmaine.com respectively.
Any users connected via a MMC connection shall connect to and receive email from the MMC POP3 mail server, if said user holds a valid MMC pop mail username and password. Any user found initiating more than one concurrent connection to the pop mail server with the same username, or initiating repeated unreasonable connection requests might have their account and possibly any connection rights terminated. Such an activity may be deemed a DOS (Denial of Service) attack, and possible other legal action may be taken.
MMC will not allow any user connected to the Internet from a foreign network to relay or “send mail” through our servers. Any user not connected via an MMC dialup or dedicated connection, must use the SMTP or outgoing mail server provided by the ISP from which the user is getting access.
MMC will not allow any user who chooses to operate his or her own mail server to relay through the MMC mail server. Any mail servers operating on a network served by MMC shall be configured to send mail directly to the destination hosts and not traverse a MMC mail server. Those users who operate their own mail servers shall also limit SMTP access to those server(s) to users on the “inside” of customers said network. Failure to do so may result in termination of the users network access rights.
Right to Scan
MMC reserves the right in order to verify security policies or breaches, or to detect or investigate malicious or illegal network activity, or for any other reason deemed necessary to scan the ports of, sniff or otherwise measure the IP traffic inbound or outbound to any of it’s customers interfaces.
Junk Email Junk email or spam is unsolicited, bulk email. It is usually commercial in nature. Mid-Maine Communications does not allow or support the transmission of spam to or from our network. All incidents of spam should be forwarded to abuse@midmaine.com with full message headers. Complete headers are very important because almost all spammers forge email addresses. You can assume that the person who claims to have sent the spam, probably didn't. If any MMC users' accounts are found to be the source of spam then the accounts will be immediately terminated and legal action will follow.
This procedure will allow us to take up the issue with the spammers' ISP. If the spam continues, we will block all traffic from that address. We cannot respond to spam if messages are not forwarded with *complete* headers to abuse@midmaine.com.
Personal Web Space MMC offers its dialup customers the right to use up to 5MB of disk space to be used as a private website for non-commercial, legal use. If any content is uploaded, and found to either be commercial in nature, used in conjunction to sell products or advertising, or deemed sexual, inappropriate or otherwise illegal, the user shall immediately loose his or her rights to use this space and all content will be deleted. MMC does not warrant that the content uploaded to a personal website will be backed up, or protected from disaster in any way.
Copyright Policy
Mid-Maine Communications has adopted a policy designed to protect the copyrights and intellectual property of others. Mid-Maine Communications retains the right to terminate the system access of any subscriber or user who infringes the intellectual property rights of others.

Unauthorized Use
Account-holders shall not utilize their access to Mid-Maine Communications servers to obtain and/or utilize lists of Mid-Maine Communications users' email addresses, account information or passwords. Such activity is a breach of the privacy of our users and shall be dealt with to the full extent of the law.
Any unauthorized use of accounts or computers by a Mid-Maine Communications customer, whether or not the attacked account or computer belongs to Mid-Maine Communications, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, according to the seriousness of the attack.
Your Privacy
We do not use or disclose any information that you may give Mid-Maine Communications, such as your name, address, email address or telephone number, to any outside companies. Mid-Maine Communications may share such information in response to legal process, such as a court order or subpoena, or in special cases such as a physical threat to you or others.
